I just came across Inkscape and have been enjoying playing around with it (it's a drawing program that's good for vector illustrations).
One of the sample images on their website was a vectorized version of Michelle Trachtenberg. That made me wonder... what kind of legal issues are there with making vectorized versions of copyrighted photographs (in this case, a photograph of a celebrity)? Is the vector version considered a new piece of art that can be sold without regard for the original photograph?
EDIT: I just noticed the copyright on the bottom right of the vectorized Michelle. I wonder if that belongs to the photographer or the person vectorizing the photo.

Making the vectorized version of an original photograph would be considered a derivative work.
If the artist of the derivative work does not substantially change their work of art from the original they will not be able to legitimately claim and copyright ownership to their new work of art.
As far as the legality of vectorizing photographs, I think it comes down to the context of its creation. There are a few terms that you can look up that will have more detail regarding this, such as "Fair Use" and "Transformativeness". It would seem to me in this particular case, the vectorization is used as a demonstration and would not violate any copyright protection.

The copyright information seems to have been preserved in the transformed version, too, which would indicate that there was no intention of claiming the work as original. I think that argues in favor of the developer who is using it in an acceptable manner, under the Fair Use doctrine.

I suppose this case is a bit confusing, because there are actually 4 layers of consideration:
- The celebrity. Might not be able to sell photos of a celebrity without their permission.
- The original photograph. Don't want to sell photos taken by another photographer.
- The vectorized version. Don't want to sell photos vectorized by another artist.
- The sample version. Don't want to claim ownership of photos used as samples of software on a website.
So this is a screenshot of a software program being used to vectorize a photograph of a celebrity. And I'm not sure if the copyright information (shown in the screenshot) belongs to the photographer or the vector artist.

I'm not even sure he'd be able to answer me. Seems there were two court cases. The first for copyright infringement, which was settled out of court (though the judge did say the Associated Press would win the case). The second case was over evidence tampered with during the first case.
