I'm not naming names because this day in age, people get sued and consumers aren't allowed to tell the truth. But, I'm just curious to know, how many CPians have ever used a third party vendor that expected the customer to monitor their uptime to make sure they're compliant with the SLA?
I just heard this for the first time ever today, and well... that's a new one.

While I'm sure all vendors making claims for XYZ uptime are measuring it themselves, I wouldn't necessarily trust them to communicate back to their customers the fact that they perhaps aren't delivering on what they promise.
As such, I'm not entirely surprised vendors would tell their customers to get their own figures. After all, they (the customers) would be the ones making the complaints. And then the vendors can claim they were up, and the problem must've been on the customer's end...

Oh, I don't trust this vendor to accurately report that at all. But, to expect the customer to track it as opposed to them even bothering to pretend to... is a bit much. That's the point being made.

I would expect both sides would need to do it.
After all if a breech of contract occurs then how does the customer initiate it with assurance?
I know one company that does take compliance seriously on their end. They issue non-compliance reports before being asked. It is possible that this is because their clients are much bigger and thus would have many more lawyers. So proactive is probably best. Or maybe they just want to be seen as a better partner.

No but I did a Power plant using a uVax and BETA software and we helped them debug it.
I left the company not long after and every job we did we got sued because the PM had no idea what he was doing.

Some years ago I received an email from my internet provider saying that I had exceeded my monthly allowance. I asked them to provide the figures showing what I had used, and they told me I would have to do it myself, as they had no means to do it. I switched soon after that.

Mindblowing. How can they make the claim you went over your allowance, if they can't provide the figures used to make that assertion?
My ISP lets me view my stats in almost real-time, and download them to CSV files as often as I want. The figures aren't an exact match, but always very close to what my router is reporting for the WAN port.

I once saw a report that showed my usage was "way over" my plan (GB), but the provider never flagged me ... so I never looked at that report again.

I'm with a hosting provider (or rather, one of my clients is, but I manage everything) that provides "unlimited" storage. Which is good, because this client has a lot of large PDFs generated every day (several hundred), each containing a dozen or so hi-res images. Every day we get an email saying we have "exceeded our resource limits". First time I got this I (almost) panicked and contacted the hosting company about it. They assured me, "don't worry, there is no limit on your account. It's just that Plesk [the control panel they use] doesn't support unlimited storage so we had to put a limit in, and it will warn you each day". Which it has - every single day for the past three years. At least I know the server's up when I see that in my inbox each morning.
But Plesk - seriously??

It would be difficult for me to exceed my "unlimited" monthly allowance, but I'm elephanted if I could get my head round their "reasonable use" criteria.

If they don't measure their SLA's - how do they know if they meet them?
Do they let you the organisation specify how you are going to measure the SLA's?
If not, I recommend this high technology device to help to determine if the service levels were met: Industry recognised SLA measurement device
Ask them: if you assert they did not make their SLA's what their process would be to determine that they did?
Otherwise - indefinite free service.
