First, there is a long tradition and law that allows for fair use. If, for example, you are doing a movie review, you will have to use material which is copyrighted or trademarked, if it's nothing more than the title of the work. The law does make exceptions for this, but other provisions have a similar problem as the DCMA in the US.

"Fair use" does not mean "copy loads of stuff from other people, and add no content of your own".
Something only falls under fair use if you use it to emphasise, or as an integral part of, your own original content.
Without your own original content, it is not fair use; it is theft.
Google, and the others who steal material, add nothing.
