You haven't given us any code to see what is wrong. The validator should work with the update panel see: http://msdn.microsoft.com/en-us/library/bb398929.aspx

Well, it's not a known issue so surely you must be doing something wrong. Post code snippet related to it such that we can see what are you doing wrong.
